Do you work with represented parties?
Yes. Represented parties can still work with a neutral to settle their case. Individuals with independent counsel may seek a second opinion on their case or request our services as co-counsel.
Can I bring my attorney to mediation?
Yes and no. You are welcome to bring your attorney to the mediation session, but we ask that they stay outside the room while the session is conducted except in limited circumstances as agreed to in advance.
What if we try mediation but it doesn’t work?
If it become clear that mediation will not work for your family before your sessions have been completed, we will return a portion of your fee and refer both parties to independent counsel.
If you complete all your mediation sessions but do not reach an agreement and do not wish to continue mediating in additional sessions, you may seek an order from the court to resolve your dispute. We will refer you to independent counsel as needed.
Is mediation ever inappropriate?
Yes. When there are allegations of domestic violence we may decline to mediate (except in limited circumstances) because of the risk of undue influence, or if one or both parties have mental health or substance abuse issues that prevent them from engaging in mediation with a clear mind.
Do you provide limited scope representation?
No, except in limited circumstances as agreed to in advance.
Limited scope representation is when an attorney makes an appearance in your case in court or otherwise acts as your legal representative for a limited time and a specific purpose. For example, an attorney might appear for one hearing but not the rest of your case. We never represent clients in court. However, there may be limited circumstances in which we will agree to join a party for settlement negotiations.
Will you help me litigate my case in court?
No. We do not represent clients in court. If litigation becomes necessary, we will help you find a different attorney.
How do I know if I need independent counsel?
It is almost always a good idea to receive the advice of an independent attorney regarding your family law case. However, in many cases, it is not necessary.
There are certain circumstances in which we will strongly recommend independent counsel (such as when there are complex business interests, stocks or separate property issues, or if the amount of income available for support is in dispute) and others in which independent is mandatory (such as when you seek to make a prenuptial agreement regarding spousal support).
We will provide you with appropriate referrals if any such issues are in play in your case.
If i need independent counsel, how much will it cost?
Unfortunately, we can’t answer that question. Every attorney charges different rates, and every case has different needs.

What is a self-represented litigant (“Pro per”)?
A person representing themselves in a court of law.
Can an attorney help me represent myself?
Yes. An attorney can provide services without becoming your attorney of record for the court, preparing your paperwork and giving you advice as you represent yourself.
If I need to go to court, will you help me prepare?
No. We will help you find a different attorney if you wish.
How do I know what I need to finish my case?
There are lots of resources available online. The California Courts website has a self- help section, and many courts provide guides for family law. Look for the family court in your county for more information. We can also review your case and help you find what you need.
What is a “Postnuptial Agreement”?
An agreement modifying the nature of the legal relationship between married couples after they are already married. Can cover the same subjects as a prenuptial agreement.
